Note* | 30 November 1943 | 30 Nov 1943, Oakland Tribune (Oakland, CA) FATHER WINS GIRL'S CUSTODY MARTINEZ, Nov. 30 -- Custody of 2-year-old Sally Lane was awarded to her sightless musician father yesterday pending the return of his former wife from Canada as the bride of a Canadian Royal Air Force officer. Superior Judge Harold Jacoby ruled that the child's custody shall go to Norman Gilbert Lane, San Francisco pianist, until Mrs. Afton Lane of Rollingwood Tract, San Pablo, returns to this country after marrying Lieut. Alex Wilson at Winnipeg, Canada. Mrs. Lane will leave next Monday for Manitoba. The court's ruling interrupted a protracted hearing of Lane's motion for modification of an interlocutory decree, which he obtained on a cross complaint last December 9. Mrs. Lane was awarded the tot's custody at that hearing. Technically, the hearing was continued for the arguments of Attorney Ross Corey, representing Mrs. Lane, and Fitzgerald Ames, counsel for Lane. Mrs. Lane, who was accused of failing to take proper care of the child, had proposed to take Sally to Canada. She told the court she would be absent from the state for about three months. Testimony introduced for the blind musician revealed that he had employed a private detective last March to trail his wife to an Oakland tavern where she and two other girls assertedly met two sailors. Land told Judge Jacoby he had arranged for a home for the child in San Francisco in event he was awarded custody. Mrs. Lane introduced testimony to prove she had provided good care for her daughter during the past year. on 30 November 1943. |
